General terms and conditions in relation to the booking of flights, accommodation, package holidays and other services through us.

1. Important Information

Who we are: In these Booking Terms and Conditions,"we"and"us"refers to Baldwins Travel Agency Ltd, (Company No. 2645135) (VAT Registration No. 583742709) having its registered office at 25/27 Grosvenor Road, Tunbridge Wells, Kent, TN1 2AJ
Baldwins Travel is part of Advantage Travel Centres is the UK’s largest independent consortium of travel agents.
Definitions:
"You"or "you" means you, the customer.
"ABTA"means ABTA The Travel Association, an association of travel agencies and tour operators in the British Isles;
"ATOL"refers to the Air Travel Organiser’s Licence, granted by the Civil Aviation Authority to Tour Operators which meet their requirements in the UK;
"ATOL Protection"means in relation to a relevant Package Holiday or a flight, that the customer is financially protected should the Tour Operator or Principal cease to trade.
"Dynamic Packaging"means selecting two or more separate travel components advertised on this website (e.g. a flight and a hotel) for your holiday and booking them together, (in which case, those items together become a Package Holiday), and Dynamically Package and Dynamically Packaged shall be interpreted accordingly.
"Package Holiday"refers to a pre-arranged holiday combination of at least two holiday product components (i.e transport, accommodation or other tourist services) when sold or offered for sale at an inclusive priceandincludes either a service which covers a period of more than 24 hoursorovernight accommodation. A Package Holiday is put together by a Tour Operator.
"Tour Operator"means any party providing Package Holidays which may be booked through us, whether or not through this website.
"Travel Principal"means any provider of travel-related products and/ or services booked through this website, and includes Tour Operators, airlines, hotels, hotel chains and hotel aggregators, insurance and car suppliers.

2. CONTRACT

These Booking Terms and Conditions shall apply to all bookings of travel-related products or services (including Package Holidays) made through us, whether through this website or by telephone together with the specific details relating to your booking as set out in the confirmation in writing which you will receive if we are accepting your booking. In addition, the applicable terms and conditions of the relevant Travel Principal(s) shall apply in respect of each of the travel-related products or services you book through us.
You must be at least 18 years old to make a booking. By making a booking through us you are confirming that you are at least 18 years of age.
Only when a booking has been confirmed to you by us in writing (by email or post) shall the contract be binding in respect of that booking (see paragraphs 6 and 7 below).
Unless otherwise stated, we act only as disclosed agent on behalf of Travel Principals, in respect of any bookings you make through us whether on this website or by telephone.
When you make a booking which includes only a flight, the contract is between you and the relevant airline. When you make a booking which includes only a hotel, the contract is between you and the relevant hotel.
When you make a booking only for an ancillary service or extra such as car hire, transfers, car parking, airport lounges, travel insurance, foreign exchange, etc the contract for those services is between you, and the relevant ancillary services provider.
When you make a Package Holiday booking the contract is between you and the Tour Operator.
Where you Dynamically Package a holiday, Baldwins Travel is deemed to be the Tour Operator and therefore your contract is with Baldwins Travel.
However, in all cases, the applicable terms and conditions of the relevant Travel Principal will apply and are deemed to be incorporated into your contract.It is your responsibility to ensure that you have read and are satisfied with the terms and conditions of the Travel Principal providing those products or services.
If the terms and conditions of any Travel Principal are not available through this website, we will be happy to provide you with copies on request. If you wish to request the terms and conditions of a Travel Principal, please email us atwebsite@baldwins-travel.co.ukor call us on 01622 762141
By submitting a booking form and making payment, you are deemed to accept these Booking Terms and Conditions and the terms and conditions of each relevant Travel Principal. If you choose not to read these, that is your responsibility.
Please note in particular, that you are responsible for complying with any Travel Principal’s terms and conditions in relation to, for example check-in times, reconfirmation of flights, or other matters.

3. PRICING

We do our utmost to ensure that all details relating to prices, pictures and all other information on our website is correct and up to date. However, prices are not live and holidays and other travel-related products and services are subject to availability. Prices may change at any time. We accept no liability if a holiday or other travel-related product or service is sold out or prices have changed by the time we receive your enquiry or booking request.

4. CONSUMER PROTECTION

Package Holidays sold on this website are ATOL protected by the Civil Aviation Authority.
ATOL is a consumer protection bonded scheme, set up to protect consumers in the event of their Tour Operator ceasing to trade.
Some of the Package Holidays shown may be covered by Baldwins Travel’s ATOL licence (ATOL number 5467).
It is only when a flight is purchased as part of a Package Holiday that it is covered by ATOL Protection.
When you book a Package Holiday, you will receive an ATOL receipt.
ATOL Protection extends primarily to customers who book and pay in the United Kingdom. For more details on ATOL and ATOL Protection, visithttp://www.caa.co.uk/default.aspx?catid=27.
ABTA protection applies to services provided by Baldwins Travel but does not apply to products or services featured on this website that are provided by any Travel Principal that is not a member of ABTA. A summary of ABTA’s protection and consumer services can be found atwww.abta.com
We act only as agents for the Travel Principals actually providing the relevant services and to the fullest extent permitted by law, we shall not be liable for any act or default on the part of any such Travel Principal or its agents, employees or servants. Passengers are booked and/or tickets and coupons are issued or obtained by us subject to the conditions, regulations and terms of the Travel Principals concerned.

5. BOOKING INFORMATION

Information given by you either in the online booking form or by telephone is accepted by us as being correct unless subsequently amended by you in writing, or, in some circumstances, over the telephone.
We do not accept any responsibility whatsoever, for any inconvenience or financial loss caused by inaccurate information being supplied by you.
When you make a booking, you are confirming that you understand and have accepted on behalf of yourself and all members of your party, these Booking Terms and Conditions (and that you have been offered the chance to see the terms and conditions of the relevant Travel Principals).
All contracts you make with us (including your acceptance of these Booking Terms and Conditions) are subject to Scottish law and the jurisdiction of the Scottish Courts but you should note that the terms and conditions of the Travel Principal from whom you are purchasing services maybe subject to the law of different jurisdictions.
All contracts you make with us shall be concluded in the English language.
If your booking involves a flight you must notify us prior to the time of booking by calling 01622 762141 if any person included in the booking is not self reliant or is a person with reduced mobility and therefore requires assistance at the airport and/or on the flight. Calls cost 5 pence per minute at all times on BT landlines. Costs of calls from mobiles and other networks may vary. You should also update your air carrier after the time of booking until 48 hours prior to the flight’s departure if any person travelling on the booking has ceased to be self reliant or a person with reduced mobility or if a person previously reported to be with reduced mobility or as not being self reliant no longer falls into either category.

6. BOOKING ONLINE

Pre-requisites: You are not entitled to order products or services through this website unless you are over 18 years of age at the time of placing the order.
Placing an order: Orders for our services can be submitted by completing the online order form on our website (where available) and clicking on the "make booking" button. When you submit an order via this website, you will be sent an email as soon as possible (and at any rate within 24 hours) confirming the details of your order.
No contract at this stage: When you place an order via this website, you are making a legally binding offer to us (as agents of the relevant Travel Principal) to pay for the products or services you have specified in the online order form. No contract is created until that offer is formally accepted by us in writing. Nothing on this website is intended to mean that we are making a legally binding offer to you to provide products or services.
Accepting your order (and forming a contract): No contract for the provision of products or services is formed until we on behalf of the Travel Principal have accepted your order by sending you notice of our acceptance in writing by email or by post (or otherwise by performing the services you have ordered). The contract between you and the Travel Principal is formed on the date shown on that notice of acceptance.
Rejecting your order: It is entirely at our discretion to accept or reject any offer submitted by you via this website.
Conditions of acceptance: Orders are accepted subject to:
authorisation of your payment card;
availability of services at the stated price; and
confirmation that you have read and accepted these Booking Terms & Conditions by ticking the "I have read and accept the booking Booking Terms and Conditions" box.
the accuracy of the information you supply on the online order form.
Rejection procedure: If for whatever reason we are unable to accept your order, we shall endeavour to notify you of this promptly and shall provide a full refund of any prepayments made.
Correcting errors: Errors in your offer must be corrected by you prior to your order being accepted by us. You can correct errors that you make on the online order form as follows:
Before you submit your offer: by re-entering the relevant information in our online order form, using the relevant link at the bottom of the form where required (i.e. either "Change Contact Details" or "Change Passenger Details, etc).
After you submit your order: by contacting us by telephone, post or email prior to acceptance by us of your order.

7. CONFIRMATION, RECONFIRMATION, TRANSFER AND CANCELLATION (ALL BOOKINGS)

Confirmation:Our receipt of payment in full and your submission of a booking form or making your booking request over the telephone does not constitute confirmation of your booking, but rather that you are asking us to confirm your booking. Confirmation or otherwise is given separately as follows, and no contract will exist until you have received such confirmation in writing:
Where we are accepting your booking, you will be sent confirmation by post or e-mail. Where you are booking a Package Holiday, the confirmation will include an ATOL receipt from the relevant Tour Operator.
By asking us to confirm your booking, you accept that you will be entering into a contract with the relevant Travel Principal(s) on their standard terms and conditions. You understand that where you have chosen more than one travel-related product component, you will be entering into multiple contracts.
If you are booking on behalf of a group, we will only deal with you as the lead booking name/ passenger in all subsequent correspondence and discussion, including changes, amendments and cancellations. As the lead name, you will be responsible for the group and it will be assumed that you have the authority to act on their behalf.
Transfer:If you are unable to go on a Package Holiday which you have booked, you may be able to transfer it to another person, provided that the other person satisfies all the conditions applicable to the package, and provided that you give us reasonable notice of your intention to transfer.
Cancellation by you: You must cancel your contract by writing to us. Cancellation charges may vary depending on the period of notice given by you before the planned performance date. The cancellation fees for a specific product or service can be made available on request.
Cancellation by us: We may cancel any contract with you for the provision of products or services if we are unable to supply the products or services at the price agreed due to circumstances beyond our control: In these circumstances, you are entitled to be refunded in full all monies that you have paid to us in respect of the booking in question.
Where we cancel a contract with you for a Package Holiday where Stewart Travel is the Tour Operator (i.e where you have Dynamically Packaged your holiday through us), you are entitled to either:
a) take a substitute package of equivalent or superior quality if one can be offered by Stewart Travel; or
b) take a substitute package of lower quality if one can be offered by Stewart Travel and be refunded the difference in the prices of the two packages; or
c) be refunded in full all monies that you have paid to us in respect of the booking in question.
Reconfirmation:Where a you are asked to reconfirm a flight or return booking it is your responsibility to do so and we shall accept no liability for any inconvenience or loss suffered as a result of failure to do this.We advise that all passengers should reconfirm their flight arrangements 72 hours prior to departure.

8. PAYMENT

All holidays or travel-related products or services are to be paid in full at the time of booking. We regret that we can only accept payment by credit or debit card where you are making a booking online.If you wish to make a booking over the telephone, we can accept a cheque, but we cannot confirm your booking until we have received your cheque and your cheque has cleared.
All payments made using a MasterCard or Visa, are subject to an additional surcharge of 2%.
All payments made using American Express are subject to an additional surcharge of 3%.
There is no additional surcharge applicable to payments made using a debit card.
Payments made by cheque require 7 working days to clear.

9. SECURITY

For your peace of mind, when you are making a payment online be sure to check your browser for a padlock symbol. The padlock symbol indicates that the page you are on is secure and you can complete your transaction with confidence. The online booking facility on this website uses AES-256bit encryption to encrypt the connection between the user and the server when credit or debit card details are entered. This is an industry standard Secure Socket Layer (SSL) connection.
When making a payment online your debit or credit card is checked to protect customers from fraudulent use. We have postcode security and CVV (this is the card security code or card verification value which refers to the digits on the signature strip on the rear of your payment card).

10. LIABILITY

Nothing in these Booking Terms and Conditions is intended to exclude our liability for death or personal injury (if any) caused by our negligence, or for fraud on our part or for any other matter in respect of which it would be illegal to exclude or attempt to exclude liability.
You and we shall only be liable to each other under these Booking Terms and Conditions for losses connected with products and services ordered which are a reasonably foreseeable consequence of the relevant breach of contract. Neither you nor we shall be liable to each other under these Booking Terms and Conditions for any other loss or damage, subject to the paragraph above.
All warranties relating to our services which are not expressly stated in these Booking Terms and Conditions are hereby excluded to the fullest extent permissable by law. We make no guarantee that our products or services will be suitable for your intended use, neither do we guarantee that this website will be error-free, reliable, entirely secure, virus-free or available (especially since we are dependent on the reliability of the internet and your use of your own computer to access this service).
We shall be under no liability for any delay or failure to perform any obligation as specified in these Booking Terms and Conditions if the same is wholly or partly caused, whether directly or indirectly, by circumstances beyond our reasonable control, including the actions or inactions of Travel Principals.
In the event of any claim against us, our maximum liability is restricted to the total amount paid to us by the claimant less any expenses incurred by us.
The provision by us of a hyperlink to another website does not constitute any authorisation by us to you to access materials held at that location, nor is it evidence of our endorsement by us of the material held there.
To the fullest extent permitted by law, we exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or to a third party in connection with use of this website (or any websites linked to this website).

11. PASSPORTS AND VISAS

It is your responsibility to ensure all named passengers must be in possession of a valid passport and all necessary visa(s) and health certificates. In case of passengers being refused entry by any immigration or other authority all repatriation costs are to be borne by the passenger. 12. DATA PROTECTION

In order to process your booking we need to use the personal information about you and other members of your party which you have provided to us. Please read our Privacy Policy for details on how we handle the information you provide.

13. CHANGES TO TRAVEL ARRANGEMENTS

You may request changes to bookings or travel arrangements over the telephone but we reserve the right to require you to confirm those changes in writing before we give effect to your request.
We cannot guarantee that we will be able to change your travel arrangements after your booking has been accepted. If we are able to do so, an administration charge will be made to change the dates of travel subject to conditions of booking/ ticket and availability.
You may only cancel a booking in writing (please see pargraph 7 for information about cancellations).

14. TRAVEL DESTINATIONS AND INSURANCE

Travel to certain destinations may involve greater risk than others. We advise all passengers to review any travel prohibitions, warnings, announcements and advisory announcements by The Foreign and Commonwealth Office ("FCO") prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to these destinations can be found on The FCO website:www.fco.gov.uk/travel.
By offering for sale travel to particular destinations, we do not represent or warrant that travel to such points is advisable or without risk and (subject to paragraph 9) we shall have no liability for damage or losses that may result from travel to such destinations.
We strongly advise you to carry appropriate travel insurance to cover you for losses sustained in relation to cancellation, health, accident, baggage, crime etc.
Neither we nor any of our agents or servants shall be liable or responsible for any loss, damage, or injury (except as provided above), delay or inconvenience whatsoever to any traveller or his luggage or other personal property sustained or suffered in, or during, any passage, journey, trip or stay, or in respect of any accommodation or in the carrying out of any arrangements booked through us.
